¿Reforma o sustitución? La tensión entre el poder de reforma constitucional y la sustitución encubierta del texto fundamental
Este trabajo examina el conflicto entre el poder de reforma constitucional y los lími tes que impiden su utilización como mecanismo de sustitución encubierta del texto fundamental. En todos los marcos constitucionales se identifican niveles de rigidez normativa, sujetos con poder de reforma y mecanismos de control institucional que operan para preservar la identidad constitucional. A partir del análisis de límites expre sos e implícitos, se destaca cómo la reforma constitucional puede derivar en ruptura institucional si se vulneran los principios fundantes, los derechos fundamentales o la estructura del Estado. Este estudio concluye que la reforma es necesaria, pero no debe confundirse con una refundación constitucional encubierta, que únicamente corresponde al poder constituyente originario

Reform or Substitution? The Tension between the Power of Constitutional Reform and the Covert Substitution of the Founding Document
This work examines the conflict between the power of constitutional reform and the limits to its use as a mechanism for the covert substitution of the founding document. All constitutional frameworks contain some degree of normative rigidity, actors with the power to reform, and mechanisms for institutional control that serve to preserve the constitutional identity. Based on an analysis of the express and implied limits, the article highlights how constitutional reforms can lead to institutional rupture if they undermine foundational principles, fundamental rights, or the state structure. The study concludes that while reform is necessary, it should not be confused with covert refoundation of the constitution, which falls exclusively within the purview of the original constituent power.

Reform oder Ersetzung? Die Spannung zwischen dem Auftrag zur Reform der Verfassung und der verdeckten Ersetzung des Grundlagentextes
Die vorliegende Arbeit befasst sich mit dem Konflikt zwischen dem Auftrag zur Verfas sungsreform und den Grenzen, die seiner Nutzung als Mechanismus zur verdeckten Ersetzung dieses Grundsatztextes gesetzt sind. In allen Verfassungsrahmen sind ein bestimmter Grad normativer Strenge ebenso identifiziert wie die reformberechtigten Subjekte und die institutionellen Kontrollmechanismen, die zum Einsatz kommen, um die Verfassungsidentität zu wahren. Ausgehend von einer Analyse der expliziten und impliziten Grenzen wird herausgearbeitet, wie eine Verfassungsreform zu einem institutionellen Bruch führen kann, wenn die zugrunde liegenden Prinzipien, die Grundrechte oder die Staatsstruktur verletzt werden. Die Untersuchung kommt zu dem Ergebnis, dass die Reform notwendig ist, aber nicht mit einer verdeckten Neufas sung der Verfassung verwechselt werden darf, die ausschließlich der ursprünglichen verfassunggebenden Gewalt vorbehalten ist.
