La elección popular de jueces: un análisis sobre su incompatibilidad con la independencia judicial
Este ensayo analiza el rol de la independencia judicial como elemento esencial para la vigencia del Estado de derecho y la consolidación de la democracia, así como las distintas dimensiones que integran este derecho. Se exploran los argumentos utili zados por algunos países de la región, a fin de justificar la adopción del método de elección popular para la conformación del poder judicial. En ese sentido, se presentan los riesgos de las elecciones populares de juezas y jueces para la plena vigencia y efi cacia de la independencia, imparcialidad y autonomía del poder judicial. Finalmente, se concluye que este mecanismo representa una amenaza directa a la integridad de la función judicial y a la vigencia del Estado de derecho, por lo que resulta incompa tible con los principios de una democracia constitucional.

The Popular Election of Judges: An Analysis of its Incompatibility with Judicial Independence
This essay analyzes the role of judicial independence as an essential element for the validity of the rule of law and the consolidation of democracy, as well as the different dimensions comprising this right. It explores the reasoning used by some countries in the region to justify the adoption of popular elections for the conformation of the judicial branch. In this sense, the article sets out the risks of the popular election of judges to the full validity and effectiveness of the independence, impartiality, and autonomy of the judiciary. It concludes that this mechanism represents a direct threat to the integrity of the judicial function and the validity of the rule of law, rendering it incompatible with the principles of a constitutional democracy.

Zur Direktwahl von Richtern: eine Analyse ihrer Unvereinbarkeit mit der richterlichen Unabhängigkeit
Der Beitrag analysiert sowohl die Bedeutung der richterlichen Unabhängigkeit als wesentliches Element für den Bestand des Rechtsstaats und die Konsolidierung der Demokratie als auch die unterschiedlichen Rechtsdimensionen. Dabei wird auf die Argumente eingegangen, mit denen einige Länder die Einführung der Direktwahl von Richtern für die Zusammensetzung der Gerichte begründen; zugleich werden die Risi ken dargelegt, die mit einer solchen Direktwahl für die umfassende Geltung und Wirk samkeit der richterlichen Unabhängigkeit, Unparteilichkeit und Autonomie verbunden sind. Abschließend wird festgestellt, dass der Mechanismus eine direkte Bedrohung für die Integrität der richterlichen Tätigkeit und die Geltung des Rechtsstaats darstellt und deshalb mit den Grundsätzen der konstitutionellen Demokratie unvereinbar ist.
