La interpretación conforme en el ámbito judicial y la acción de inconstitucionalidad concreta

El presente artículo se circunscribe al ámbito de la aplicación judicial de la Constitución, debido a que nos interesa saber la manera en que el ordenamiento jurídico boliviano resuelve la controversia judicial en la que el juez advierte la inexistencia de una interpretación conforme a la Constitución de la disposición legal que debe aplicarse al caso concreto. Aquí se precisa el valor normativo de la Constitución, para establecer los alcances de la interpretación conforme. A partir de estos cánones teóricos se describe la regulación legal de la acción de inconstitucionalidad concreta y, posteriormente, se evalúa la necesidad e idoneidad de dicha acción para, con base en ello, concluir que la inexistencia de una interpretación conforme a la Constitución de cualquier disposición legal no puede suspender, ni suprimir el ejercicio de la función judicial, y que la carta fundamental debe ser la norma aplicable de forma preferente para la resolución de cualquier controversia judicial.

This article is confined to the judicial application of the Constitution, as we are interes ted in understanding how the Bolivian legal system solves judicial disputes in which the judge discerns there is no constitutional interpretation of the legal provision to be applied to the specific case. In this instance, the Constitution’s normative value is defined in order to establish the scope of conforming interpretation. Based on these theoretical canons, the article first describes the legal regulation that governs specific unconstitutionality actions and, then, it evaluates the need and suitability of such action in order to conclude that the lack of constitutional interpretation for a legal provision cannot suspend or suppress the exercise of the judicial function and that the Constitution should be the preferred applicable norm to solve any judicial dispute.
