Las reformas sobre la justicia constitucional y su incidencia en el Tribunal Constitucional de Chile
Desde que en Chile se estableciera un Tribunal Constitucional, las reglas sobre su funcionamiento, composición y atribuciones han sufrido diversas modificaciones. Antes de examinar la forma en que dicha magistratura ha reaccionado frente a tales cambios, cabe recordar que el pueblo soberano se expresa directamente a través del poder constituyente y su voluntad se objetiva jurídicamente en la Constitución, la cual es su máxima expresión, ya que la soberanía es “la capacidad o facultad para positivizar las normas jurídicas de más alto rango de la comunidad”, según señala Heller.1 Entonces, para cumplir con su tarea de velar por la supremacía de la Constitución a través del control que ejerce sobre los actos de diversos órganos instituidos, el Tribunal Constitucional ha de emplear el texto supremo como parámetro de validez del resto del ordenamiento jurídico, sin que le corresponda enjuiciar el contenido que le asigne el poder constituyente, sea este originario o derivado.

Reforms on constitutional justice and its impact in the Constitutional Tribunal of Chile
Since the Constitutional Court was established in Chile, the rules governing its functioning, composition, and powers have undergone various modifications. Before examining how this court has reacted to these changes, it is worth remembering that the sovereign people express themselves directly through the constituent power and their will is legally objectified in the Constitution, which is its highest expression, since sovereignty is “the capacity or power to positivize the highest legal norms of the community,” according to Heller.1 Therefore, in order to fulfill its task of ensuring the supremacy of the Constitution through the control it exercises over the acts of various established bodies, the Constitutional Court must use the supreme text as a parameter of validity for the rest of the legal system, without being responsible for judging the content assigned to it by the constituent power, whether original or derivative.

Reformen der Verfassungsgerichtsbarkeit und ihre Auswirkungen auf das Verfassungsgericht von Chile
Seit der Einrichtung eines Verfassungsgerichts in Chile wurden die Vorschriften über dessen Funktionsweise, Zusammensetzung und Befugnisse mehrfach geändert. Bevor wir uns damit befassen, wie die Justiz auf diese Veränderungen reagiert hat, sei daran erinnert, dass das souveräne Volk sich direkt durch die verfassungsgebende Gewalt äußert und sein Wille in der Verfassung rechtlich objektiviert wird, die sein höchster Ausdruck ist, da Souveränität laut Heller „die Fähigkeit oder Befugnis ist, die höchsten Rechtsnormen der Gemeinschaft zu verabschieden”.1 Um seiner Aufgabe nachzukommen, die Vorrangstellung der Verfassung durch die Kontrolle der Handlungen verschiedener staatlicher Organe zu gewährleisten, muss das Verfassungsgericht den Verfassungstext als Maßstab für die Gültigkeit der übrigen Rechtsordnung heranziehen, ohne dass es ihm zusteht, den Inhalt zu beurteilen, den ihm die verfassungsgebende Gewalt zuweist, sei dieser nun ursprünglich oder abgeleitet.
