Tensiones y desafíos en la protección efectiva de los derechos humanos de las mujeres y de los pueblos indígenas. El caso de la Ley Pascua desde la óptica del Tribunal Constitucional de Chile
El artículo analiza los criterios jurisprudenciales aplicados por el Tribunal Constitucio nal de Chile respecto al requerimiento de inaplicabilidad por inconstitucionalidad de los artículos 13 y 14 de la Ley Pascua, como ejemplificación de las tensiones y los desafíos que aún existen en la legislación constitucional respecto a las protecciones efectivas de los derechos humanos, sobre todo a la protección de las mujeres, in dependientemente de los contextos culturales o territoriales que fueron discutidos debido al área de injerencia de la Ley Pascua, correspondiente al territorio de la isla Rapa Nui. Se aborda el análisis del Tribunal Constitucional al resolver el requerimiento apegándose a criterios de legalidad por sobre el control de convencionalidad y de tratados internacionales que le corresponde observar como garantes no solo de la Constitución, sino de derechos fundamentales, lo cual muestra la labor del Tribunal Constitucional como un horizonte difuso.

Tensions and Challenges in the Effective Protection of the Human Rights of Women and Indigenous Peoples. The Case of the Ley Pascua or Easter Island Law, from the Perspective of the Constitutional Tribunal of Chile
This article analyzes the jurisprudential criteria applied by the Constitutional Tribunal of Chile regarding the request for inapplicability due to the unconstitutionality of Ar ticles 13 and 14 of the Easter Island Law. This, as an example of the persisting tensions and challenges in constitutional legislation with respect to the effective protection of human rights, especially the protection of women, regardless of the cultural or territorial contexts that were discussed due to the Law’s area of influence, which co rresponds to the territory of Rapa Nui Island. It addresses the Constitutional Court’s analysis when resolving the request, adhering to criteria of legality over the conven tionality control and the international treaties it is required to observe as guarantor of both the Constitution and of fundamental rights, demonstrating that the work of the Constitutional Court is still ambiguous.

Spannungen und Herausforderungen beim effektiven Schutz der Menschenrechte von Frauen und indigenen Völkern. Der Fall des Osterinselgesetzes (Ley Pascua) aus der Perspektive des chilenischen Verfassungsgerichts
Der Artikel analysiert die vom chilenischen Verfassungsgericht bei der Behandlung des Antrags, die Artikel 13 und 14 des Osterinselgesetzes aufgrund ihrer Verfassungswi drigkeit nicht anzuwenden, zugrunde gelegten Rechtsprechungskriterien als Beispiel für die Spannungen und Herausforderungen, die in der Verfassungsgesetzgebung hinsichtlich des wirksamen Schutzes der Menschenrechte, insbesondere der Rechte von Frauen, weiterhin bestehen, unabhängig von den kulturellen oder territorialen Kontexten, die aufgrund des Geltungsbereichs des Osterinelgesetzes, das für das Gebiet der Insel Rapa Nui gilt, diskutiert wurden. Dabei wird auf die Analyse des Verfassungsgerichts eingegangen, das bei der Entscheidung über den Antrag den Gesetzmäßigkeitskriterien Vorrang vor der Überprüfung der Vertragskonformität und der internationalen Verträge einräumt, die es als Garant nicht nur der Verfassung, sondern auch der Grundrechte zu berücksichtigen hat, was die Arbeit des Verfas sungsgerichts in einem diffusen Licht erscheinen lässt.
