La competencia consultiva de la Corte Interamericana de Derechos Humanos (Corte IDH) ha significado el ejercicio de una función dirigida a procurar la más amplia protección de los derechos humanos, con innegables impactos en los Estados de la región. En el desarrollo de esta competencia, la Corte IDH lleva a cabo una labor de interpretación jurídica en sede judicial, dirigida a desentrañar el sentido y los fines de las normas internacionales en materia de derechos humanos, con el propósito de fortalecer las obligaciones de respeto y garantía a cargo de los Estados, y de coadyuvar en las tareas propias que, en este ámbito, corresponden a las instancias internacionales. En el desarrollo de su función, la Corte IDH tiene un amplio margen de discrecionalidad para determinar la pertinencia y oportunidad de emitir un pro nunciamiento, lo que le ha permitido definir y reconfigurar el objeto y los alcances de esta competencia.

Purpose, Scope, and Impact of the Advisory Opinions of the Inter-American Court of Human Rights: Some Considerations
The advisory jurisdiction of the Inter-American Court of Human Rights (IAHR Court) has implied exercising a function aimed at securing the broadest possible protection of human rights, with undeniable impacts on the states of the region. In the exercise of this jurisdiction, the IAHR Court undertakes legal interpretations in the judicial sphere for the purpose of unpacking the meaning and purposes of international human rights norms. The goal is to strengthen the state’s obligations to respect and guarantee human rights and to contribute to the specific work that corresponds to international bodies in this area. In carrying out this function, the IAHR Court has a broad margin of discretion to determine the relevance and appropriateness of issu ing a ruling, which has allowed it to define and reconfigure the purpose and scope of this jurisdiction.

Überlegungen zu Gegenstand, Umfang und Wirkung von Rechtsgutachten des Interamerikanischen Gerichtshofs für Menschenrechte
Die Begutachtungskompetenz des Interamerikanischen Gerichtshofs für Menschen rechte (IAGMR) beinhaltet die Ausübung einer Funktion mit dem Ziel eines möglichst umfassenden Menschenrechtsschutzes, die eine unverkennbare Wirkung in den Staaten der Region entfaltet. Bei der Ausübung dieser Kompetenz nimmt der IAGMR vor Gericht eine Rechtsauslegung vor mit dem Ziel, Sinn und Absicht der internatio nalen Normen auf dem Gebiet der Menschenrechte zu erklären, um die staatlichen Verpflichtungen zu ihrer Einhaltung und Gewährleistung zu unterstreichen und einen Beitrag zu den Aufgaben zu leisten, die den internationalen Instanzen auf diesem Gebiet obliegen. Bei der Ausübung seiner Aufgaben verfügt der IAGMR über einen großen Ermessensspielraum bei der Entscheidung über die Relevanz und Aktualität einer Stellungnahme, was es ihm ermöglicht, den Gegenstand und Umfang dieser Kompetenz zu definieren und neu zu gestalten.
