La Constitución ecuatoriana de 2008 como signo lingüístico inconcluso: la elocuencia de los silencios del constituyente de Montecristi
La constitución, como norma fundamental del Estado, regula los elementos esencia les de la vida política, social y jurídica. Sus autores, los constituyentes, deben elaborar un texto que represente de forma fiel y concisa a la sociedad. Por ello, la constitución no es un objeto inanimado, sino un instrumento que requiere sintonía con quienes representa. No obstante, Ecuador no ha logrado materializar plenamente esta aspira ción. En 2007, la Asamblea Constituyente de Montecristi se reunió con la pretensión de refundar el país. Para entonces, Ecuador ya había tenido dieciocho textos cons titucionales, muchos con un valor meramente solemne y alejados de la ciudadanía; este nuevo intento se vio limitado por las ambiciones personalistas del gobierno de turno, lo que dio lugar a un texto que oscila entre los valores tradicionales del constitucionalismo ecuatoriano y la influencia de intereses políticos coyunturales. Como resultado, rige una carta con validez formal, pero con escaso significado para la sociedad ecuatoriana.

The Ecuadorian Constitution of 2008 as an Unfinished Linguistic Sign: The Eloquent Silences of the Montecristi Constituent Assembly
The constitutional, as a fundamental norm of the state, regulates essential elements of political, social, and legal life. Its authors, the constituent assembly members, aretasked with producing a text that accurately and concisely represents society. The constitution is thus not an inanimate object but a tool that must be in harmony with those it represents. However, Ecuador has not yet fully achieved this aspiration. In 2007, the Montecristi Constituent Assembly convened with the purpose of “refound ing” the country. By then, Ecuador had already had 18 constitutions, many of merely formal documents, disconnected from the citizenry. This new attempt was limited by the personalist politics of the sitting government, resulting in a text that oscillates between the traditional values of Ecuadoran constitutionalism and the influence of short-term political interests. As a result, while the new constitution is formally in force, it holds little meaning for Ecuadoran society

Die ecuadorianische Verfassung von 2008 als unvollendetes linguistisches Zeichen: zur Eloquenz des Nichtgesagten durch die Verfassungsgeber von Montecristi
Die Verfassung regelt als grundlegende Norm eines Staates die wesentlichen Aspekte des politischen, gesellschaftlichen und rechtlichen Lebens. Ihre Autoren, die Verfas sungsgeber, müssen einen Text ausarbeiten, der die Gesellschaft wahrheitsgetreu und prägnant abbildet. Die Verfassung ist somit kein unbelebtes Objekt, sondern ein Instrument, das im Einklang mit denen steht, die sie repräsentiert. Ecuador ist es jedoch nicht gelungen, diesem Anspruch vollständig gerecht zu werden. Im Jahr 2007 trat die Verfassunggebende Versammlung von Montecristi mit dem Anspruch zusammen, das Land neu zu gründen. Zum damaligen Zeitpunkt hatte Ecuador bereits achtzehn Verfassungstexte, die in vielen Fällen lediglich von feierlich-deklara torischem Wert waren und keine Bürgernähe aufwiesen; der neue Versuch litt unter den Restriktionen durch die personalistischen Ambitionen der damaligen Regierung, sodass ein Text entstand, der zwischen den traditionellen Werten des ecuadoriani schen Konstitutionalismus und dem Einfluss konjunktureller politischer Interessen schwankt. Im Ergebnis ist die geltende Verfassung formal rechtsgültig, hat jedoch nur geringe Bedeutung für die ecuadorianische Gesellschaft.
