Protesta social, derechos humanos y discurso de las “manzanas podridas” en Colombia
El presente artículo analiza el contenido y alcance del derecho a la protesta social desde la perspectiva de los derechos humanos en la región interamericana. Para tal efecto, se examinan las restricciones que legítimamente se pueden imponer al ejercicio de este derecho en atención a los postulados de la Convención Americana sobre Derechos Humanos. Igualmente, se hace hincapié en la situación colombiana frente a la protección y garantía de la protesta social, así como en la postura asumida por el Gobierno nacional ante los agentes estatales que vulneran los derechos de quienes participan en las manifestaciones. Todo esto con el propósito de poner de presente la desprotección en que se encuentran quienes deciden ejercer su derecho a la protesta social en el país.

Social protest, human rights and the discourse of “rotten apples” in Colombia
This article analyzes the content and scope of the right to social protest from the perspective of human rights in the inter-American region. For such purpose, it examines the restrictions that can legitimately be imposed on the exercise of this right in view of the postulates of the American Convention on Human Rights. Furthermore, it emphasizes the Colombian situation with regard to the protection and guarantee of social protest, as well as the posture assumed by the national government against state agents who violate the rights of those who participate in demonstrations. All of this is done for the purpose of highlighting the lack of legal protection for people who decide to exercise their right to social protest in the country.

Sozialer Protest, Menschenrechte und der Diskurs von den „faulen Äpfeln” in Kolumbien
Der Beitrag analysiert Gehalt und Geltungsbereich des Rechts auf sozialen Protest aus der Perspektive der Menschenrechte in der Region Amerika; dazu befasst er sich auch mit den Beschränkungen, denen die Ausübung dieses Rechts nach Maßgabe der Postulate der Amerikanischen Menschenrechtskonvention legitimerweise unterworfen werden kann. Weiterhin wird auf die Lage in Kolumbien hinsichtlich des Schutzes und der Gewährleistung von sozialen Protesten sowie auf die Haltung der kolumbianischen Regierung gegenüber staatlichen Akteuren eingegangen, die für die Verletzung der Rechte von Demonstrierenden verantwortlich sind. Damit soll auf die Gefährdung von Personen aufmerksam gemacht werden, die sich dazu entschließen, von ihrem Recht auf Protest Gebrauch zu machen.
