Los derechos sociales en el contexto del nuevo sistema de justicia laboral en México
El sistema de justicia laboral en México se renovó. Ahora la manera en la que se visualiza la justicia laboral debe ser a partir de la concepción del derecho social. Si se aprecia de esta forma, se garantiza la vigencia del derecho al trabajo y su efectiva aplicación acorde con los cambios sociales. Dentro de estos cambios se encuentra la reforma constitucional y legal del sistema de justicia laboral en el país. Así, la impartición de justicia se traslada a tribunales laborales y organismos administrativos, los cuales están encargados de realizar la conciliación; de igual forma, se establecen instituciones y figuras jurídicas que garantizan la libertad y democracia sindical, así como la libre contratación colectiva. La instrumentación de este nuevo modelo representa uno de los retos más importantes que ha enfrentado el sistema de justicia, respecto del cual ya se cuenta con diversas acciones que ha emprendido el Estado mexicano.

Social Rights in the context of the new labor justice system in Mexico
The labor justice system in Mexico has been reformed. Now labor justice must be visualized based on the conception of social law. If seen in this way, the validity of labor law and its effective application in accordance with social changes is guaranteed. Among these changes are the constitutional and legal reforms made to the labor justice system in the country. The administration of justice has been transferred to labor courts and administrative bodies, which are responsible for carrying out conciliations. In addition, legal institutions and mechanisms have been established that guarantee union freedom and democracy, as well as free collective bargaining. The implementation of this new model represents one of the most important challenges that the justice system has faced, with respect to which the Mexican State has already taken various actions.

Die sozialen Rechte im Kontext des neuen Arbeitsgerichtssystems in Mexiko
Das mexikanische Arbeitsgerichtssystem wurde reformiert. Damit gilt die Arbeitsgerichtsbarkeit ab jetzt als im Sozialrecht begründet. Aus dieser Perspektive ergibt sich eine Garantie der Geltung des Arbeitsrechts und seiner effektiven Umsetzung, in der sich die sozialen Veränderungen widerspiegeln. Teil dieser Veränderungen ist die Verfassungs- und Gesetzesreform im mexikanischen Arbeitsgerichtssystem. Die Rechtsprechung wird dabei auf Arbeitsgerichte und Verwaltungsorgane übertragen, deren Aufgabe die Konfliktbeilegung ist. Darüberhinaus werden Institutionen und Rechtsfiguren errichtet, die die gewerkschaftliche Vereinigungsfreiheit und Demokratie ebenso garantieren wie die unabhängigen Tarifabschlüsse. Die Umsetzung des neuen Modells stellt eine der wichtigsten Herausforderungen dar, mit denen sich die Justiz bisher befassen musste, wobei der mexikanische Staat bereits mehrere Klagen eingereicht hat.
